Ranch hand for Texas Rep. Flores wanted in fatal beating

McAllen, TX -- A ranch worker hired by a Texas lawmaker is a suspected
illegal immigrant now wanted in the fatal beating of a young Hispanic
man, authorities said Monday.
Hidalgo County Sheriff Lupe Trevino said Froylen Casares, 24, is
suspected of using a bat to beat another man to death on the ranch early
Monday. Casares, a Honduran, remained at large Monday afternoon.
'It was a very bloody, very bloody, very gruesome crime scene,' Trevino
said in a story for Monday's online edition of The Monitor in McAllen.
Authorities declined to name the dead man, who was killed in a shed next
to horse stables on the ranch.
Casares was employed at a ranch owned by state Rep. Kino Flores, who
said he hired the man without checking his immigration status.
'He was preppy. He looked the part. No indication. He fit in extremely
well, he had family members here,' Flores, D-Palmview, told the
newspaper. 'It just looks bad in general. I certainly don't want to go
around challenging people's status.'
Flores said he did not know the victim.
Casares' immigration status and whether Flores broke the law by hiring
him would have to be investigated by Immigration and Customs
Enforcement, Trevino said.
'I will make our documents, our case available to them,' the sheriff
said.
An ICE spokeswoman declined to comment Monday night, saying the agency
has not reviewed the case and has not been asked to assist.
'If they call us in to determine the immigration status we will,'
spokeswoman Nina Pruneda told the newspaper.

On Thursday, the government of El Salvador urged Salvadorans not to
travel illegally to the United States because of the danger of dying on
the way or being detained and deported back to the country.
The Vice-Chancellor for Salvadorans Abroad, Margarita Escobar, said to
the press :"The lecture presented is the following: in the first place
to point out the enormous risks involved in traveling in an undocumented
manner. We see what happened in Phoenix, Arizona, where there are
several dead in an accident and many others where there are assaults and
deaths on the way." Escobar cited that last August 7th five undocumented
Salvadorans died in a traffic accident in the American city of Phoenix,
when they were traveling in an SUV along with 13 other persons also in
illegal status in that country.
Daily, between 200 and 400 Salvadorans weighed down by unemployment or
precarious economic situations decide to leave the country and set off
on their journey as undocumented ones, the majority to the United
States, according to data from international organizations.
According to official figures, in the last three years 216,773
Salvadorans have been deported back to the country from different
nations, especially the United States, Mexico and Canada.
The Salvadoran government is also worried by the constant operations
which the United States immigration officials carry out in search of
undocumented workers in factories and other establishments.
Escobar said "The risk of being detained and deported continues to be
felt due to the policy of that country and of the application of its
present law about immigration."
El Salvador carries out a radio campaign warning against traveling
undocumented to the United States because of the "dangers" of the trip.
595 persons were detained Monday in a round-up of illegal immigrants in
a factory in Laurel, Misisipi (sic), among whom it is presumed there are
at least four citizens of El Salvador, according to data from the
Chancery. The Vice-Chancellor pointed out the need for a resumption of
discussion of the design of an integral immigration policy which can
give stability to the millions of people who live in that country
illegally. The official said "Once the political time takes place,
Congress must return (to the discussion of) integral immigration reform"
Some 2.8 million Salvadorans live abroad, 2.3 million of them in the
United States and their individual monetary remittances are important in
upholding the country's economy..
El Salvador, according to the Central Reserve Bank, closed 2007 with a
total of 3.695,3 billion dollars, 6.5% more than in 2006 and this
represents 18.1% of the country's Gross Domestic Product.

The auxiliary bishop of the Ciudad Juarez diocese, Jose Guadalupe
Torres, criticized the construction of the border fence currently taking
place in El Paso and said that it is reprehensible that American
officials are building a barrier that divides both countries. He added
that this represents a blow to freedom, besides that "it goes against
human rights, of free transit, of seeking roads to the well being for
all, I believe that building a fence is not the solution (because) all
it does is increase the danger for all persons who wish to improve
themselves."
He indicated that despite the barriers which the American officials
might install, the migrants will continue to enter that country even
though their lives might be at greater risk.
He added: "The migrants have said that even if they put in "a thousand
vigilance (sic), install radars and the Minutemen continue, they will go
on risking their life as long as they can reach "the American dream" "
He stated that the building of the fence is not the way and for that
reason he asked officials of the neighbor country that, instead of the
building project, they should offer sources of employment in conjunction
with Mexico and bring about temporary work projects to facilitate the
entry of migrants into the United States in an organized and reasonable
fashion.

An unfinished narco-tunnel
was discovered today in Mexicali, Baja California. The tunnel, 6 meters
under the surface, measures 120 meters in length and is 1.5 meters
wide. The construction was interrupted 60 meters from entering the US.
The tunnel has lighting, ventilation, air conditioning and an elevator,
according to the state police. Eight people have been arrested and
admit working on the project for the purpose of smuggling drugs.

Dallas Morning News Editorial: Obama, McCain avoid immigration reform

Barely a year ago, illegal
immigration was Topic A on America's agenda. It turned CNN's Lou Dobbs
into a household name. This newspaper, recognizing the issue's
importance, selected the illegal immigrant as our Texan of the Year –
not because we approved of illegal immigration but because of the huge
political and social impact the phenomenon was having on our state.
Boy, did we touch a nerve.
So imagine our outrage that
neither Republicans nor Democrats addressed it substantively during
their recent national conventions. It was as if Barack Obama and John
McCain regarded the entire topic as radioactive. When it comes to
answers, the two men running for president either have no new ideas or
are too afraid to venture forth with them publicly.
American voters must not
allow a leadership vacuum to persist on a problem of this magnitude.

State Rep. Leo Berman,
R-Tyler, said today that he’ll run for governor at the end of the 2009
legislative session if he doesn’t succeed in passing legislation
targeting illegal immigrants.
“If we can’t get anything
done next session because it’s blocked, I will run for governor at the
end of the session,” he said in an phone interview from Dallas/Fort
Worth International Airport, where he landed early this evening after
attending the GOP convention in St. Paul, Minn.
Attorney General Greg
Abbott’s office today released a document showing Berman has requested
Abbott’s official opinion on whether a House member would lose his seat
if he announces his candidacy for governor during the first year of a
two-year term.
Berman said he wants to keep
his House seat and that if Abbott rules that he would have to give up
his seat to run for governor, that would factor into his decision
whether to run.

FAIR has learned from Congressional staffers that the full House
Judiciary Committee will meet this week to consider four
immigration-related bills, all of which are a gift to big business
special interests seeking to expand the number of employment-based
visas. If passed, these bills will flood our workforce with foreign
labor in a time when unemployment is rising and recently hit a high of
6.1%.
At a time when many are looking for jobs, the House Judiciary
Committee is set to pass H.R. 5882, H.R. 6020, and H.R. 5924 - all of
which will dramatically increase the stream of foreign workers
coming into the American workforce:

H.R. 5882 would reach back to
1992 and "recapture" employment-based and family-based visas,
potentially adding over 550,000 new green cards.

H.R. 5924 would lift the cap
on employment-based visas for nurses and physical therapists until
2011.

H.R. 6020 would grant amnesty
to illegal aliens who are family members of armed forces
personnel.
In addition, the House Judiciary Committee will be considering
H.R.5950, which details vast new immigrant detainee
healthcare requirements that Immigration and Customs Enforcement (ICE)
would have to implement in all of its detention centers. This
unnecessary bill - a clear tactic by illegal immigration opponents to
slow law enforcement - will only serve to add extra bureaucratic
burden to ICE.

Members of the House Judiciary Committee today and tell them not to
bow to cheap labor interests and that you oppose each one of these
bills!

Postpones Vote on Foreign-Worker Bills

House Judiciary Committee did not take up two foreign-worker bills
yesterday because of time restrictions, they remain an active threat.
The bills are: H.R. 5882, which would add an additional 550,000
permanent green cards; and H.R. 5924, which would add 20,000 additional
foreign nurses per year for three years (plus their families).
Please contact
your U.S. Representative through the Capitol Switchboard (202-224-3121)
and ask him/her to do everything possible to stop the passage of these
bills, which could come up for a vote again next week.

Calif. Court Denies Illegals In-State Tuition Benefits

WASHINGTO
(UPI via COMTEX) -- A California appellate court has thrown out a state
law providing tuition breaks to illegal aliens, possibly opening the way
to denial of other benefits.
A three-judge panel of the California Court of Appeals ruled unanimously
Monday that the law, which permitted illegal immigrants to attend public
colleges and universities at in-state tuition rates is unconstitutional
because it conflicts with federal law. The panel said the law violates
both the equal protection clause and privileges and immunity clause of
the Constitution.
The ruling has an immediate impact on about 80,000 non-resident American
students denied in-state tuition benefits in California. The court
ordered they must be permitted to pay in-state tuition and be reimbursed
for any higher amounts they may have already paid.
Michael
Hethmon, general counsel for Immigration Reform Law Institute, said in a
news release issued Tuesday that the ruling is precedent-setting. "In
their ruling, the judges indicated that federal law pre-empts not only
California's in-state tuition law, but all such laws across the
country," he said.
Kris Kobach, another attorney for the institute, which brought the case,
called it a victory for "law-abiding citizens and taxpayers."
Nine other states offer in-state tuition benefits to illegal aliens.
The California ruling will also affect many other state and local
benefits currently being offered to illegal aliens, the group says.

punish businesses that hire illegal immigrants.
The U.S.
Ninth Circuit Court of Appeals affirmed a U.S. District Court ruling
Wednesday upholding the state's Legal Arizona Workers Act. The law
suspends or revokes the business licenses of employers caught knowingly
hiring illegal immigrants.

Senator Hutchison's Washington office, E-Verify has been extended till
March 2009 where it will be brought up again. The President should be
receiving the Continuing Resolution within a few days for his signature.

prepare to fork over $1 trillion in taxpayer funding to rescue Wall

Illegal couple applied for home loan using stolen SSNs
Arizona Department of Public Safety detectives arrested a
couple applying for a $159,000 home loan using stolen social security
numbers and false immigration documents.
Jose Ozuna Alvarez and Ana Laura Balerrama are both
believed to be illegal immigrants. Investigators said they got jobs,
bought as many as three new vehicles and obtained multiple credit cards
using stolen social security numbers - one belonging to a nine-year-old
child.
Immigration and Customs Enforcement is holding the pair
for deportation.

Wanted" list captured in Los Angeles
Arrest ends two-year hunt for suspect linked
to Guatemalan human trafficking ring
LOS ANGELES - A 28-year-old
Guatemalan woman wanted for her alleged role in a sex trafficking ring
that smuggled young Central American women into the United States and
forced them to work as prostitutes was arrested here this afternoon by
agents with U.S. Immigration Customs Enforcement (ICE) and the FBI.
Maribel Rodriguez Vasquez,
one of the fugitives featured on ICE's "Most Wanted" list, will make her
initial appearance in federal court tomorrow morning to face federal
charges. Her capture yesterday capped a nearly two-year search during
which her case was featured by "America's Most Wanted."
In December 2006, an arrest
warrant was issued for Vasquez after she was charged with knowingly and
intentionally concealing, harboring, and shielding illegal aliens for
financial gain; importation into and harboring of aliens in the United
States for purposes of prostitution; and aiding and abetting.
Homeland Security replaces head of troubled border
program

congressional fire for technical problems and cost overruns surrounding
efforts to build virtual fencing along the nation's borders, the
Homeland Security Department has replaced the official in charge of the
multibillion-dollar program, CongressDaily has learned.
Sources on and off the Hill
said they hope the removal of Gregory Giddens as chief of the Secure
Border Initiative will breathe new life into the troubled program.
The most problem-plagued
program that Giddens managed was SBInet, which is focused on using both
technology and traditional fencing to secure the nation's borders.

UPDATE on saving the E-Verify system to keep illegal aliens from U.S.
jobs
DEAR FRIENDS,
I'm sending this only to those of you who really helped us these last
three months of trying to save the E-Verify system. Thanks for all that
you have done.
The good news is that E-Verify will not die Nov. 1, which it was set to
do unless Congress re-authorized it before leaving town to campaign.
The brinkmanship is over for now. Senate Majority Leader Reid finally
granted a stay of execution and allowed a short extension of E-Verify in
the giant Continuing Resolution that just passed the Senate to keep the
government running through the fall and winter.
But instead of the 5-year extension that the House passed in the summer
(thanks to your outpouring of support), the Senate has extended E-Verify
only until March 6 next year.
That means that Arizona, Oklahoma, Georgia and several other states and
localities that have laws requiring the use of E-Verify will be able to
continue to drive illegal aliens out of their communities.
But all the danger we faced this summer will re-emerge just before March
6.
As soon as the new Congress arrives in January, the Open-Borders forces
will once again try to attach amnesties for illegal aliens and huge
increases in foreign-worker visas as ransom for continuing E-Verify, the
most effective program we have in fighting illegal immigration.
Those forces did everything they could -- and succeeded -- in kicking
this issue into next year in great faith that the new President (McCain
or Obama) will push through a full-scale amnesty before vigorous
enforcement can create an accelerated Attrition Through Enforcement.
You see, leaders like Sen. Reid, Speaker of the House Pelosi of
California, Sen. Lindsey Graham of South Carolina and both Presidential
candidates do NOT want illegal aliens to lose their jobs. They don't
want illegal aliens t! o go hom e.
So, those leaders have either blocked or done nothing to unblock passage
of the 5-year extension of E-Verify (H.R. 6633) in the Senate.
THIS IS STILL QUITE A VICTORY FOR YOU
I don't want to be too pessimistic about all of this.
Because of your outpouring of faxes and phone calls, the Senate did NOT
attach the hundreds of thousands of additional visas for foreign workers
that congressional leaders had sought. That truly is a major victory for
us.
ONE LAST CHANCE MONDAY
We actually have a slight chance of still getting the 5-year extension
before Congress leaves town this week.
Congress is expected to be in session at least through Tuesday.
Right now, all Congress seems to be hearing is public outcry against the
$700 billion bailout (created partly because so many financial
institutions gave house mortages to illegal aliens).
A full barrage of phone calls all day Monday is worth the try. At least
let these Senators know that their perfidy didn't go unnoticed.
Call your 2 Senators and demand passage of H.R. 6633 before they leave.

Tell them that you know the reason for putting this off until next March
is the hope of Open-Borders champions to attach an amnesty then.
H.R. 6633 passed the House with only two people voting against it. Tell
the Senators that it is insane not to pass -- or attach to another bill
-- something that was so nearly unanimous in the House.
Another reason for being really obnoxious with phoning on Monday is to
send these Senators home to their states' campaigns with a kick in the
pants to remind them that immigration is not off the agenda with their
constituents.
Many of you have said you want to do much more than just call your own 2
Senators. My advice is to pick out all the small-population states in y!
our regi on and call their Senators, because they may not have had quite
the flood of phone calls yet.
